IBAC announces scope of investigation into conduct of the former Assistant Commissioner of Victoria Police Professional Standards Command

Victoria's independent police oversight agency, the Independent Broad-based Anti-corruption Commission (IBAC), today detailed the scope of its investigation into the conduct of former Victoria Police Assistant Commissioner Mr Brett Guerin, and associated matters.

IBAC’s Commissioner, the Honourable Robert Redlich QC said: "IBAC's Operation Turon will examine Mr Guerin's conduct in posting inappropriate material under various pseudonyms on social media."

"It will also examine the extent to which Mr Guerin's conduct, in his role as the head of Professional Standards Command or otherwise, may have affected the investigation and outcomes of matters where racism and other potential breaches of anti-discrimination or human rights law may have been relevant."

IBAC's investigation will also include assessment of the adequacy of relevant Victoria Police policies and procedures, and recommend ways to strengthen Victoria Police’s systems and practices to prevent misconduct.

IBAC has powers equivalent to those of a standing royal commission. It can investigate allegations of police misconduct where Victoria Police personnel fail or refuse to perform their duties; behave disgracefully or improperly (on or off-duty); discredit other Victoria Police personnel; bring Victoria Police into disrepute or affect public confidence in Victoria Police.

IBAC also has a legislated responsibility for ensuring police officers have regard to the Charter of Human Rights and Responsibilities Act 2006.

"Given the serious nature of the reported conduct, the level of concern expressed by the community is understandable," Commissioner Redlich said.

"Victoria Police is fully cooperating with IBAC's investigation and providing every assistance requested."
